Re: Question for the credit swavy!! (about collection delete)

i am confused as to what kind of contract it would be considered? It was a home phone line in nevada with nevada bell. SOL in nevada is

written contract    6
oral contract        4
promissary note  3
open accounts    4
Debt was from june 04 from nevada

I live in New Jersey now and that is
written contract  6
oral contract       6
promissary         6
open accounts   6

Re: Question for the credit swavy!! (about collection delete)

The SOL shouldnt apply here, IF this was truly paid as the OP said in the beginning.  Do you have proof of payment?  What you ll need to do next is DV the OC and start that whole process to get it removed.

Now, the DOFD is important as that will be the 7 year start date for reporting on your CR.   But if you ve paid it, AND can show that, then who cares about the SOL?

Why does the sol not apply here if it is paid? Yes i did get a letter saying that it was paid from them. When i write a DV do i write it to the Original Collector or Original Creditor?  DOFD I really dont know when that was as this account was from my father using my name for a phone line. I know that it says june 1 2004 as the date assigned and also still reports as unpaid at one credit agency deleted at another and remains as paid on another

That's true sh9730, I forgot about that in all of those posts.  However, you don't DV the OC, as they don't have to answer a DV.  You would send the OC an OC letter that you can search for on these threads.  But the discussion is about the CA that won't delete, so DV the CA and then tell them to FOAD.

Yes, you would have to create your own FOAD letter. They're too incendiary to keep in the sticky threads! good luck
