Should I file for a chargeback? Amex gold card

Good afternoon folks,

 

Im a bit in a pickle, see I moved to eastern europe from the US about 5 months ago, everything has been going good so far until about 2 weeks ago when I bought an expensive item off Amazon UK - but it was a third party seller. It was all fine and dandy until i received the product, which wasnt as described, actually it was a different item ( example would be if you ordered Iphone 14 and you received the Iphone 13).

 

In good faith I tried resolving it with seller, after a couple of days back and forth I contacted Amazon and told them what happened so they forced the seller to issue me a return label so I can ship the item back to the seller ( in China). 

 

Seller keeps claiming he sent me the right item, its a very frustrating situation that I have never dealt with in my life. Lived about my whole life in the US and never had an issue like this. So, seller keeps on claiming he sent me the right item and says only will refund if I shipped him back what he is claiming he sent me? Ridiculous I know.

 

I talked to Amazon UK right before I shipped the item back and they flat out were encouraging me to file for a chargeback with my CC with is Amex Gold. 

 

Im a bit stumbled, item should get back to seller by Friday, should I file for chargeback or keep working with Amazon? Is it better dealing with Amex? Any suggestions would be appreciated.

 

Item price was north of $3000

Better to work with Amazon.

keep working with amazon to get full refund back if in case don''t issue you the refund time to call amex.
