Timing After A Dispute.

Recently, I disputed items on my credit report.  How much time is given to the creditor to reply to my dispute?  I was told that a creditor has 30 days to reply,  if the time lapses the disputed items are automatically removed from my credit report.  Is this true?

No (and some folks might disagree(and I want to be corrected if wrong)). The dispute process under FDCPA applies to the initial communication between CA and consumer (sect. 1692g). CA will state that you have 30 days to dispute and so on. If 30 days had passed and the CA is on your CR, you can still do a DV; they just don't have to respond. They also don't have to remove their listing off your CR. However, by using DV letters found in this forum, I have been successful in removing collection accounts off my CR. To an uneducated eye, the letters found on here look intimidating. CAs are looking for an easy kill, not one looking to fight back.

If you disputed an item directly with the CRA and they did not verify this item within 30 days, the item should be removed from your reports.

CreditOne,

That is the reason the CRA's give collectors the 30 days. If they do not verify the information with the CRA within the 30 days then it will be removed.

Re: Timing After A Dispute.

Sorry, I misinterpreted "... I disputed items on my credit report."

Ditto to the others...

FCRA at 15 U.S.C. § 1681i:

(5) Treatment of Inaccurate or Unverifiable Information

(A) In general. If, after any reinvestigation under paragraph (1) of any

information disputed by a consumer, an item of the information is found to

be inaccurate or incomplete or cannot be verified [@ 30 and up to 45 days], the consumer reporting

agency shall –

(i) promptly delete that item of information from the file of the consumer,

or modify that item of information, as appropriate, based on the results

of the reinvestigation...
