I understand that if you default on a credit card debt and then leave the state/country, you may be subject to tolling laws of the state you started your account.
My question is - if I have a credit card account in good standing in the state of my residence and then I move overseas to europe and continue to use my card, and also inform the card company of my change of address and new statements come to my European address. And then some time later (years) I default on my CC payments. Do the tolling laws of the state I initially started the account still apply?
thanks for any help in this matter
YES!! I have talked to several people in the depart. that handles consumer debt in 2 states. No one know the answer.
Tolling was added to the SOL for dead beats that just changed their addy to another state to get away from paying. It was never updated for people that really move out of state or country.
If you default after many years in another state (with proof like a D/L) that you moved several years ago.......You can use that in court. It is always up to a judge how he will rule.
Remember a CA has the right to use either SOL and may try to bully you into paying. In most cases unless it is a bunch of money owed a creditor or CA will file suit in the state where you live.
As to living overseas the CCC might cancel your CC.
Thanks for the replies HappyDays and Rubaty - appreciate it,
Just for a bit more info - the cc account has been closed for some time (4+ years) because I defaulted on payments. I did use the card for over 2 years while in europe and had address of record changed with cc company and they sent statements to me at european address. I am moving back in spring and just want to know what my rights are. The debt is considerable (10,000$). I obviously am open to working something out with CA but also don't want to do something foolish that will harm me either.
The sol is 4 years in the state that I opened the account. They haven't contacted me but they have contacted members of my family who informed them that I moved overseas. My family wouldn't give them my contact details - but it always struck me as funny that they didn't have them already as the cc company sent my statements overseas.
Anyway - I suppose I should consult a professional who can advise me. Does anyone have any recomendations?
thanks again
