Validation of disputed bill

Hi, I'm new to the forum but love what I've been reading here! Lot's of smart folk posting with great infoSmiley Very Happy I'm hoping that someone will be able to help me out. I have been disputing a lot of the old accounts on my credit reports. However, this weekend I received a letter from an attorney representing one of these accounts stating that the company has turned the file over to them for litigation to collect the outstanding balance unless I paid the bill in full or worked out an agreement with the company. I want to dispute this debt and ask them to verify said debt. I realize that if they do not validate that this is my account within 30 days that the debt must be removed from my credit report. However, in his letter the attorney states that my request for verification will not prevent initiation of suit against me. What do I do? Thanks for your help! Candie

Send them a DV letter. Per the FDCPA, the CA has an unlimited amount of time to verify the debt and they can continue to report during that time. The 30 day period is a common misconception. However, per the FDCPA, you have 30 days from the date of their dunning letter to send a DV. Maybe they'll stop the process and verify first.

Are you inside of the SOL? You'd want to check that first. As you experienced, never touch an unpaid debt if SOL hasn't expired.

Is this for an OC account? If so, then I probably would just pay it without a PFD and then GW later. But again, check your SOL. If outside SOL, then I'd answer anything from the court and would tell the attorney to go pound sand.
