Voicemail message regarding PFD

I received a voicemail on Saturday.  It is from one of the companies that I sent a PFD letter to.

The voicemail, I believe, is in violation of the FDCPA.  The voicemail states simply:

Hi Samantha, if you would please give me a call back at 1-800-xxx-xxxx extension xxx.  I'm calling about a letter you sent me.  I hope you're having a great day.

It does not give the name of the company or the name of the person calling.  Am I incorrect in this?

I have not attempted to return the call.  If I return the call it will simply be to state that I would like future contact to be made in writing only.

Any input would be greatly appreciated!

Re: Voicemail message regarding PFD

I have a semi-related issue.  I have been getting calls from Fidelis Recovery something or other (I googled the #) and they have done a HARD pull on my CR but are not reporting anything.

But the real issue is the voicemail they left.  It was automated and stated the message was ONLY for me and if this is not "me" please hang up now.

Then it goes on to state that this is an attempt to collect a debt - all of this on a voicemail that they they cannot be sure who they are leaving it for.

It was on my cell phone - and I use a voicemail "service" that emails me a copy so I have it as "evidence", LOL.

Is leaving a voicemail stating it is an attempt to collect a debt a voilation?

Re: Voicemail message regarding PFD

I sent the PFD that Tuscani posted.  In the letter, it states that the validity of the debt is disputed and the payment is just to make things easier.  They get their money, I get it off my credit report.  The amount is less than $50.

I don't think there's a FDCPA violation. Tusc's PFD letter doesn't tell them to stop calling. As per talking to them, well, I wouldn't. But that is me. However, you don't have anything to lose. I wouldn't accept anything less than an agreement on their letterhead based on your terms.

Re: Voicemail message regarding PFD

I am looking through FDCPA and it says what they cannot say, but it doesn't say what they must say.  I would think that they have to at least tell you their name and their company.  Pooh!

I absolutely will not discuss terms.  I'm offering 100% PIF, so there's not much more that they can want!  It's a measly amount less than $50.00.

Thanks for the feedback!

Re: Voicemail message regarding PFD

So, I ended up calling this woman back.

They will only take a payment and update it to paid.  I asked that all future correspondence be in writing and she said there's really nothing to discuss, that it's owed and they'll only take a payment in full.

I thanked her for her time and we hung up cordially.

Now, I did this a little bit backwards.  I still have not DV'd the company.  I got a little backwards about how to do things.  Should I go ahead and DV them?  I'm not sure what the next steps should be!  : (
