What would be best to do?

I know.....most say never talk on phone.....but I called a CA showing on my report to get the OC's information.

They stated that this account was closed and sold and no longer belonged to them and could not help me. I said it is still on my report.

After them trying to tell me I was full of it, they told me to fax them a copy of the report pulled today showing them on there and they will take care of it.

She asked once during the call if the balance showed $0 and I told her no.

Now, I am wondering if I send this report if they'll just change the balance to $0 or take it off.

Would I be better to DV them or do as she instructed?

Do they have to remove the account once they sale it?

Don't send them a copy of your report.  If you have no account with them, as they say, then they have no right to see it!  Evn if you do have an account, you are under no obligation to do their job for them.  You know it's on your report.  You don't have to prove it to them.

Send the CA a DV letter CMRRR.  As soon as you get the green card back, dispute with the CRA.

If you truly have no account with them, they will not be able to validate and must delete.  If they verify the CRA dispute, and you truly have no account with them, then that is a violation.

If the reason you don't have an account with them is because they have sold it to a JDB, then be on the lookout for them coming out of the woodwork.

They have and I've already DV. The account is not mine.

So is a CA supposed to remove the account from your report once they sale it? Or can they just report $0 balance and the account as closed and leave it there for 7 years?

If it wasn't for different CA reporting the same accounts then I'd only have 4 things to PFD/DV.

Some accounts are listed by 4 different CA.

I read a lot of bad things about AFNI and CBCS, know of them?

AFNI is on there but list nothing but Account #, Date opened, Balance Date, Date of Status, Status, and address. No OC, no balance, no payment amount............

I sent a DV to the new CA that is contacting me regarding the account.

LVNV Funding is reporting it.

Midland Credit is reporting it.

Now, Vital Recovery Services is contacting me about it.

LVNV is the one I called and they said they sold it to Midland Credit and don't have it no more and wants me to send them a copy of my report.

I have not contact Midland Credit, have a letter in envelope to take to post office tomorrow.

Vital Recovery Services I sent a DV day after I got their letter.

DOFD is 04/2002.......will come off 04/2009.

Is telephone bill so I am not sure where it falls under SOL. I know the SOL for my state, but not sure where telephone bills fall in the categories.

If I DV, they can't validate if they don't own, right? If they don't respond or fail to validate then it comes off report, right?

I thought they only had 30 days to validate, Vital Recovery said it could take up to 2 months or longer.

Re: What would be best to do?

On this website, I have read nothing but NEGATIVE about Midland and LVNV.  Don't send them crap!!  When I read that, I think I gasped out loud!!!  Keep us posted on this because I am curious how this will work out for you.

Re: What would be best to do?

Let me start over.

ANY  CA that is reporting or that contacted you.....send a DV  CMRRR  ( except the one that you talked to)  For them first dispute with all CRAs that are reporting!!!

IF it comes back verified.....that is their first violation!

When a CA contacts you in any way & they are NOT reporting........you have 30 days to send a DV.....they can NOT report until they answer the DV!!!  If they do it is a violation!

IF it is already on your CR.....send a DV....they have 30 days to answer it & they CAN report during that 30 days BUT not after until they answer the DV.

NEVER send a CA a copy of your CR!!!!!!!!!  Never sign your name just type it!!  Never give any info. to a CA  at all!!!!

Are you getting the DOFD from CR  that a CA is reporting?

Ok.......let me make sure I have this straight....

Since I already talked to LVNV and they said they don't own the account, I shouldn't DV, I should dispute with the credit bureaus that show it on my report? I would dispute as I don't owe it or what?

For Midland, I should just DV them and not dispute with credit bureaus. This will allow them to continue reporting for 30 days but after that they must either verify or remove from report? If they have already sold the account, then they can't verify--right? Therefore they'll remove from report.

When Vital Recovery contacted me, they were not reporting and still are not, I DV'd them.

All the letters I have typed and the few I've already mailed, I've not signed at all, only typed.

The dates I got from calling the credit bureaus themselves.

Sorry if it sounds like I am repeating something, but I just want to double check and make certain I am understanding correctly and don't mess something up.

On Midland, I disputed a few years ago and they said it was verified. I didn't know nothing at that time and just let it go, does this affect anything? I don't understand how it was verified, they didn't send me any proof or nothing. I only found out the outcome after checking my report again. I guarantee they have NOTHING showing this is my debt, because it is NOT my debt.

Re: What would be best to do?

As suggested, I disputed the LVNV Funding with the CRA reporting it.

I pulled a new report and it says "Consumer disputes - reinvestigation in progress"

Here's the thing, they updated the account last Thursday.

How can they update an account that is in dispute and they have admitted that they don't own?

Is that a violation?

Re: What would be best to do?

YUP violation.................MOV the CRA  CMRRR

Talk is cheap..........if they are reporting send them a DV  CMRRR  wait for 30 days   then dispute.

They can keep updating until their 30 days are up!

NEVER  open another dispute or MOV  untill all disputes are answered.....If you have an open dispute & make another dispute OR MOV   they will also update their records & add another 30-45 day wait.

Be sure to always keepp hard copies of all your CR!!!!!!!!!
