hospital sued me

I received a subpoena to appear in court for a claim from the hospital where I had my daughter who is two years old. I had no knowledge of this debt since at the time of delivery I had private insurance and the public. I never received notification about this debt. my problem is that I do not work but I am afraid that the joint account with my husband to collect the debt is possible?

Yes, they will seize whatever assets they can, including all funds in any bank account with your name on it. Your best bet is to call them and set up a payment plan.

Are you asserting that the debt was previously paid, or for some other reason is not legit?

The primary issue is whether or not you consider the debt to be legit rather than simply not being aware.

Your joint assets can only be attached by court order. So no matter what you do, please go to court because if you don’t, a judgement will definitely be entered against you.

So as @RobertEG asked, do you owe the money? It doesn’t matter at this point in time whether you got a notice or not of monies due the hospital?

If you don’t owe, now is the time to get your documentation in order. Get a copy of hospital and insurance records together to present in court.

If yes you owe, then as @Anonymous said, call hospital and set up a payment plan and get it in writing. Then you can present the payment plan to the court.

I thought that the debt had been paid. Since it is the cost of when I gave birth to my daughter and having health insurance, I thought that the whole process was covered by it. I know that the debt is legitimate only that I thought it was paid.

I'll go to the court this Friday
I received the notification last Friday and as two years have passed I did not know where to go to find out if the insurance paid or not. Because I never received a letter of collection, I assumed that my insurance had paid everything related to the delivery. I do not know if I should call the lawyer's office that is asking me or wait to go on Friday and there establish the payment agreement. Friday is the preliminary trial

I do not work and what I would pay a better lawyer I will repay the debt I have with the hospital. Thank you

It really depends on the type of insurance you had. It could have been a 90/10, 80/20, even a 60/40 coverage. 

 

GO TO COURT and ask for an extension. State you thought it had been covered by your insurance but since you just got the subpoena on such-and-such a date, you need the time to gather the insurance and hospital records. No way would I pay for something without making sure whether it was covered by my insurance or not.
