when I moved they didn't forward my credit card

not sure what to do. I had excellent credit 850 and then I moved. I had all of my mail forwarded except for some reason one of my credit cards never forwarded with the rest of my mail. Because of this, I was deliquent at least 60 days, I had no idea that I even had a credit card I wasnt paying. A credit collection agency finally caught up with me and I paid the bill immediately. Do I have any recourse in this area for being late in that they never forwarded my bill to the new address? When I pulled my credit report this was the only thing that was negative but because it was months before I even knew about it it killed my score.  Can I write to the credit card and agency explaining that it was not technically my fault???

You can file a dispute under the Fair Credit Billing Act (FCBA) if you feel that the billing error was on their part.

The outcome would likely be based on who was at fault for the "for some reason" the billing was not sent to your proper address

Re: when I moved they didn't forward my credit card

One aspect of our OP's story that is not encouraging is the length of time that it took.  Apparently so much time passed that the credit card company eventually turned the debt over to a collection agency.  That typically doesn't happen for a long time (several months), and before they do that they are usually calling you and emailing you multiple times as well as writing you.

This would appear to mean that the OP did not update his phone number or email address or US postal address with his creditor, either at the time of the move or within the following 90 days.  (And typically a cell phone or email address is unaffected by a physical move of one's residence.)  It sounds like he was relying purely on the mail forwarding of paper mail done by the US postal service.

Naturally I am on the side of the OP and I hope he can get this resolved in his favor.  But it may not be easy.

For the future I hope that he chooses to set up autopay for all his creditors, so that accidentally being late can never happen to him again.

Re: when I moved they didn't forward my credit card

OP,

Was it the credit card or the statement that was not forwarded? When I moved, neither my bank, Macy's or Citi forwarded my cards; they were returned. But because I was on the lookout for the cards and had not received them, I called and all three informed me that they do not forward credit cards or bankcards, which in hindsight makes sense. Now, if it was your billing statement, I don't understand why that wasn't forwarded. I would call the CC company and explained what happened, especially with scores like yours. They may be understanding and delete the lates. But like CreditGuy said, definitely setup autopay. Good luck.
