Hi folks,
Need some suggestions on how to argue/appeal this situation. A little background: 2008 went through a messy divorce, ex-husband was awarded the marital home + all marital debt. Judge gave ex-husband 5 years to sell or refinance home (5 years up on July 2013). Ex-husband never put home on the market, wanted to refinance. I signed the quit-claim deed, per order of Judge. So,I took the kids (HIS KIDS) and moved to an apartment. Ex-husband is in law enforcement, with many friends in high places.
Recently, I pulled my credit and found out ex-husband has not been paying the mortgage and it's on default close to $12,000. My dream of becoming a homeowner again shattered, until I learned about the Section 502 Direct program. Sent in the prequalification application, and got a call from a USDA RD rep. that said that although I signed the quit claim deed and divorce decree says the house is not mine, USDA will still count the mortgage payment into the PITI ratio and therefore making me not eligible for the program. USDA rep. suggested to get a "release of liability" from the mortgage company, before trying again to obtain a USDA loan.
Although, I understand where USDA is coming from, It doesn't seem one bit fair... I'm a displaced homemaker, getting yet another door slammed in my face. I'm gainfully employed and patiently waited 4+ years for my chance to rebuild my life. Does anybody know how can I argue this case on my favor? Any suggestions? Thoughts?

they can make an exception to your issue if the mortgage was current while you lived there.

I can't get a conventional mortgage, because my name is still on the marital home's note. I kept payments up to date when I lived there. How would I go about asking for an exception?

He is suggesting you try for FHA... and FHA for the exception

FHA is not conventional.
and your loan officer you deal with can get the exception granted.
case by case as always. but i have seen it done.
