Landlord issue with rent verification

We have our conditional approval and our closing date on the 28th of April. Our last condition is the rent verification. We have been here for 11 years with initial rent to own. It became a rental after the 3 years. We have litteraly outgrown this house as my husband and I had all 8 of our children when we moved here. . We don’t need 5 bedroom home anymore. Our landlord is stalling with the form. I got a email from her today saying she got the form but way to busy to fill it out . Maybe next week. My mortgage broker said to say it’s for a preapproval and I did that but I believe my landlord took the form to her broker friend. In the form it says I have applied for a mortgage loan please fill out the short form below. My Head LO said if she won’t cooperate we can try the LOE with the year of electronic transfers to her acct being accepted . I sent her the email I received from my landlord today and will send LOE explaining this whole situation . Can the underwriter really deny our loan because of her actions. I know we have time but the seller and Us are both in Cancun the week before closing and both return home two days before closing. We will have laptop and everything we need to send any last minute requests. Sorry to vent . Just afraid landlord can screw this whole thing up. Oh and we haven’t had a lease in 5 years. Our lawyer said to give her 30 days and pay rent that month . As we are month to month with no lease. Any encouraging information will help.

Yes, the underwriter "can" deny the loan for that reason, but it's unlikely to happen.

 

I had one set of renters buy a house and I - their landlord for several years - never recieved a form to fill out or a phone call for rental verification.  I learned later the guys had to jump through hoops to be approved for a mortgage.  Things like refinance their car to a lower payment to qualify for a mortgage.

 

I had several other sets of renters that moved on and never received a form to fill out or a phone call for rental verification.  Makes ya wonder...

 

For your situation, I would write a LOE and show the history of paying rent on time.  Provide it now, just in case.

Can you use bank statements to show rental history?

Some loan programs require a Documented 2 year history of paid rent, others do not.

 

If you can show payment by way of canceled checks or bank statements, that and an LOE should be the work around that you need.

However, it would be nice if the landlord would cooperate.

Agreed.  As a landlord myself, I always work with tenants who have been respectful.  This has included letters of verification.  Sorry your landlord isn't as reasonable.
