Removing Mortgage lates

Afternoon All ,

I awarded the house to my ex 3.5 years ago now. I now realize what a mess it has made and realoy didn't expect to me remarried 3 years later but was blessed with meeting an amazing woman. Now we are planning to buy a house and am working on my credit and her since her history is new.  I stipulated in the divorce decree that my ex was responsible for the loan and taxes and had 3 yrs to refianance and get my name off loan or sell. the house sold in June 2015.  In my situation has anyone had luck using goodwill letters to get lates off their record ? I have read the loan predates the decree so obligation is to the loan. Would be nice to get lates off the loan for at least the last 3 yrs would help.

Unfortunately I dont think any lenders will work with you on that.

 

they always fall back on "Well, you did sign a contract"

I have had a lender that will look at the PSA (Property Settlement Agreement) and if the house is awarded to one of the spouses and is responsible for the payments, they will acknowledge that the spouse without the asset and without payment responsiblity isn't responsible (the new lender - not the lender where the mortgage was late).

So keep your evidence for your new lender + a LOE..

 

However, that won't help you with the lates. It will only support your explanation for the new lender and they may not (not sure here) hold the lates against you for a new mortgage.
