hi, new to the forum but looking for some quick advice, ran into an odd snag today as i was planning on doing a pre approval in the next 30-60 days. So my daughter is turning 18 at the end of september and my child support is approx 2 months overpaid. As it was explained to me several months ago the support would stop prior to the end date because of this overpayment. i got a letter from the county today stating that while the support will indeed stop going to her mother the county will still be deducting it from my pay and impounding it until the actual date of termination of the court order which is 9/30/2020 then returning the overpaid balance to me. The problem is 2 fold, 1. this support payment increases my DTI approx. 9% and 2. my lease is up in december which will make it nearly impossible to find a home, get closed, and move by that time. my main question is will a lender factor this in if i would decide to apply prior to the end of september (i have the paperwork to prove that the support has in fact ended but the money is being impounded.
Even without the overcollection (this is too complicated to ever explain to the lender) you child support ends in just a couple months and with 98% if the lenders they will not count it. That said does the support absolutely end or does it continue should this child continue onto college? This makes your end date something you can't prove.
I would get all your documentation together and get a pre approval now with a lender who won't count an obligation ending in 3 months. Really this should not be an issue!
Ends on 18th birthday or upon high school graduation, whichever comes last so it's done.

I recently had a similar situation with one my borrowers. We requested all supporting documentation to include a copy of the child's birth certificate, and my Underwriter allowed the debt to be excluded. You'll need to make sure you don't hook up with a Rookie Loan Officer.
