ADT Security Run-Around Collections

My fiance and I recently pulled her credit report because we are starting the house hunting process. We noticed she had a Collection record on it from "Perfection Collection" and the original source was from ADT security. She had ADT years ago before we were together and had paid everything off so naturally we were confised as to what this was. She contacted ADT and keeps getting shuffled around and needless to say, their customer service has not been helpful at all. She kept getting sent to different numbers to contact and when she tried the latest number today, she was told that it should not have been sent to collections as she had made the account in full before it got to that point. She asked if they were able to give her anything stating that fact but they said they were unable to. She also asked what she needed to do to get this off her credit report and wasn't able to get an answer from them other than "we can't help with that.". She is going to call this "Perfection Collection" group and see where it gets her, but with everything that has happened so far, we aren't holding out breath. We have filed a dispute online through Transunion but without any physical proof from ADT stating that it was paid off and should not have gone to collections, I'm not sure how far that will get us and I can't seem to log back in to check on the status of the dispute and update it with the information we have found out.

 

Does anyone have any suggestions regarding the matter?

We spoke with Perfection Collection and they are adamant that they are owed $1,323. They stated they took the account from ADT for that amount and for it to be removed from her credit report it would need to be paid in full. They asked for her credit card number, which she declined to give because the whole thing seems very shady. She called ADT again after speaking with the collection agency and was able to get a supervisor who stated that she saw nothing on her account indicating it was sent to collection or that it should/would have been sent to collection. She said there was a small balance of $199 on it, but that was it and as long as that was paid, he account would be good to go. No idea what is actually going on. Like I said, we filed a dispute with Transunion and we just filed a complaint through the BBB (what good it will do, we don't know) but we are at whits end and don't know what to do.

The CFPB will be your friend if the CA isnt removed.

1) This is why lawyer access for minor issues is IMO critical ( no not just because it's a plan I offer)

2) If it were me
a) I'd handle the $199 balance that ADT claims is ALL the money, they claim has EVER been due ( This gets them BACK IN the line of future 🔥 and clears up any ambiguity of supposed balances)
The $199 payment would an conditioned endorsement that this amount is indeed the total and only balance due to ADT
I'd request a Final Close out accounting from ADT, just to attest I owe NOTHING ( there needs to be no negotiation or pleading to fix anything or wondering why or transferring to whom...just for my records I want to accounting of my account ( maybe my accountant needs it for tax purposes) I just need a zero balance agreed by ADT from ADT)

Once they cashed the payment...

If no lawyer...you can send an affidavit yourself to their legal department of your intent to sue based upon their agency/assignment to said CA
I'd include a Certified Copy of THEIR accounting show a zero balance regarding said account
Along with correspondence from said CA claiming purchase/assignment of the account from YOUR organization to their... either they outright hacked the information from your records during a data breach, you didn't inform me of or there is a HUGE error going in between you and this associated party.

If the matter isn't resolved within 10 business days
I'll have no choice but to sue, both companies and allow the court system to figure it out.

Copies of my concerned complaint, will also need to be filed with the BBB, State's Attorney General, the CFPB if we can't clear this matter up, again within 10 business.

Then again a letter to the CRA with the intent to sue them for reporting false, unverifiable damaging info

* There are consumer lawyers that will take it from there once you're clearly saying ADT says nope, you got no balance with us should NOT be there it's a wrap and an easy $1000 violation and there are plenty No Cost lawyers that will scoop up the G for their pockets and all you wanted was the clean record

It's like a slip n fall case, lawyer takes the lay up you get the results no fuss no muss
Generally once their legal departments get involved, ish gets done because COST becomes a factor

Wait for the results of the dispute before taking any further action.

You must have the results of a prior dispute that was verified by the debt collector before you can bring any legal action.   FCRA 623(c).

 

If the collection is verified, you can either send an intent to sue letter or simply bring your own civil action and obtain judicial review of the facts as to whether or not the debt collector ever obtained legitimate collection authority from the creditor, and thus had any right to report a collection.
