Advice for newcomer

Hello everyone. Im new here and just starting my journey to building decent credit.

 

Having pulled my report I have nothing good (or listed)

1 State Lien for $2000

 

And 4 collections listed.

2 Medical Bills 2 years old that are both under $100

 

And 2 other bills, one from A cable company and 1 from a Eye Doctor that are both 6 years old.

 

Of all of the collection I honestly had no clue I owed anything so they were a surprise to me to see.  The 2 small Medical Bills I do recognize partially. I had a collapsed lung at that time, but thought insurance paid for it.    Do I deal with the OC or CA?

 

 

But the Cable Bill and Eye Doctor ones are the OC, and have been reported collection agencies. ((Credit Protection Assoc and GLA Collections))

 

Im not exactly sure I did the right things, but I disputed both with the CRAs.

2 days later, I called each one to confirm the Account numbers for the DV, as my credit report X out a number on them,  They both gave me their acct. Number as well as the OCs account number.

 

So, I have a DV ready to send that looks something like this:

 

To Whom It May Concern:

This letter is in response to our initial communication, dated 8-2-2012.

To the best of my recollection, I do not believe I have incurred or have a debt with the Original Creditor named on the alleged debt, nor that I have any legal obligation to pay your company for the alleged debt.   Due to these facts, I would like to exercise my right to request a debt validation, before any discussion on the matter can proceed.

This is not a refusal to pay, but a notice that your claim is disputed and validation  is requested as per the Fair Debt Collection Practices Act.

 

I am NOT a requesting a "verification" of your records, such as a print out of alleged debt with my name typed on it. 

I am requesting competent proof or VALIDATION that the alleged debt is legitimate, your company has the right to collect it and I have any legal obligations with your company. 

Proof of my liability is my legal right under the Fair Debt Collection Practices Act.

 

Please provide me with the following:

-Please provide me with copies of any signed contracts, that show I have any legal obligation of the alleged debt to your company

-Proof your company owns the alleged debt or has been assigned by the Original creditor to collect the debt

-Account statements from the original creditor which:  identifys them, shows all charges, total amount due, and what they were for

 

 

 

Am I asking for to much and should I get all of this information before paying?   I honestly have no recollection of having a cable account with Adelphia Time Warner, or visiting the names eye doctor.

 

Secondly, what would the statute of limitations be on these and which state applies?

Collection Agencies State, My current home state, or the state the alleged bills were incurred?  Im not sure if these are written contract, Oral, revolving or what.

 

 

 

Any help and/or advice would be appreciated.

 

 

 

 

 

--- ALSO.   SInce technically our initial contact was my phone call to them for acct numbers and address info,  are they not required to send me something in writing about the debt and allow for dispute etc?   Or does this no longer apply.

Welcome to the forums.

 

A DV letter should be short and sweet. Much of what you wrote is not required of a CA (Collection Agency) by law. All they have to provide is the amount owed and the name of the OC (Original Creditor).

 

They are under no obligation to ever answer a DV but until they do they must stop collection efforts.

 

Something like this is all you have to say in a DV letter. Send it CMRRR.

 

"You say I owe a debt. Please validate".

 

Do not use the word "dispute" anywhere in your letter. That could lead to a "consumer disputes" comment on your reports and that can lead to other problems.
