CA not actively collecting

How do I deal with a CA not actively collecting on a debt?

I have 2 accounts w/ National Credit Systems, 1 of which they've reported as closed. Im assuming they still having collection authority because they have the other account still (both come from a broken lease), there's still a balance on the TL and I'm able to look up the account on their site. But they just sent me a settlement offer on the "open" account with no mention of the "closed" account. How do I handle this? They're still under SOL until May 2017.

A positive update on their part that their collection is "closed" clearly implies that they no longer have collection authority.

I would interpret it as such.

 

You could eitther call them to confirm, or simply contact the CRA and request deletion based on the CRA policy that a debt collector should delete their collection if they no longer have collection authority.

So what course of action do I take if they still have collection authority but just aren't actively collecting (hence the closed status). It's still under SOL but if something warrants a deletion of the account besides them losing collection authority id like to pursue it and try to PFD the smaller account w/ them since they just sent me a settlement offer.

The consumer cannot instruct or require a debt collector to be more active in their collection activities, and most likely would not want to do so.

 

If they choose not to devote current efforts to actively pursue the debt, that is not basis for requiring deletion of their reporitng.
