I am not sure what my next step should be with this new collection account that was added yesterday.. 3/24 recv'd a letter from CA about $1200 debt from OC (dentist) date of service 11/2009, 4/22 sent DV to CA and a letter to OC asking for detailed billing as insur should have paid this amnt. Neither OC nor CA responded...4/29 insurance pd OC $700. On 5/25 CA reported to cra: $1200 orginal amount owed, 11/2009 dofd, 4/29 lst pymnt date, $500 bal remaining.... how can they report anything when they didnt respond to my dv, also not sure if they have the right to report this when my insur pd the OC 2 pymnts total and is making the final pymnt next week, I've never pd this CA anything so how can they report this pymnt my insur made directly to OC. Not sure what to do, anyone with tips please chime in. TIA
If you DV'd the CA, and they have not responded, they cannot post anything to your CR. Are you sure they recieved the DV letter?
As far as the OC sending it to collections, they had the right to do that. It does not matter if you have insurance or not, the consumer is still responsible for the bill if insurance does not pay, or is slow in paying. Maybe they should have let you know that your insurance had not yet paid.
I would contact the OC and ask them to recall the account from the CA. Tell them you had no idea your insurance had not paid it and they (OC) failed to let you know or you would have taken care of it. Let them know how it is affecting your credit. As it is, the OC only has to let the CA know they have received payments and the CA will update accordingly.
Do not contact the CA at all.
You can try the HIPAA process. Google it to see what you need to do.
Thanks guiness56, I contacted the OC and they are going to pull it back as they have received the final payment from insurance company. Hopefully my poor score recovers, working on increasing and this drop had me bummed.
I could use some help on this one still, I just started the Hippa process last week, hopefully it works in my favor. Yet before doing this I reported the CA to the BBB & my states consumer protection department. Even when the OC told the CA to stop contacting me because the insurance paid this account to a $0 balance & it was a filing error on the billing clerks part they continued to report and did not withdraw the entry from my credit file. My concern/question is the CA has provided by SSN in a rebuttal letter to the consumer protection department. Are they able to disclose this confidential info?
