CC Considered Open for SOL Purposes?

I did a search on this subject and got more confused!  Does anyone know for certain whether a CC is considered an open account or written contract for SOL purposes?  On the threads that came up during my search there seemed to be varying opinions on this and some even said that different state's courts had ruled one way while others went the other way (I am in FL if anyone knows how they've ruled).  I have a credit card that went to collections and if it is considered an open account, would be outside of SOL, but if considered a written contract, would not be.  Thanks a lot.

Re: CC Considered Open for SOL Purposes?

CC would be considered an "open" account since it's revolving credit.

Hey! I'm in FL, too! Small world!! Smiley Happy

Thanks, wonderin.  So I guess I'll get that DV out then.
And, yeah, it is funny that you're in FL as well.  Is it just me or is this summer even hotter than normal...or do I say that every summer?  (I think it's the latter!)

Are you kiddin' me??? We're in Northern FL (the Panhandle) and I swear, when I go outside, I picture a big kid focusing a magnifying glass on me as though I were an ant!! Smiley Happy

I don't even think I want to know how hot it is further south!! o_O

As to the DV, you should be fine. I really don't see you waking any sleeping giants with a pointy stick. But still, keep your eyes pealed for some sort of action. Just cause they can't win in court if you show up doesn't mean they won't TRY. Smiley Sad

Who's the CA, if you don't mind me asking? You might find out here if someone else has had luck with PFDing .... you might even get some good addies to send it to!!
