I have a capital one account on my credit report that was opened by a family member. They chose to add me on to the account as an authorized user. I never used the card and now Capital one is reporting me as a joint owner. The account was charged off. I have disputed that I am not a joint owner. Requested proof of a signature, etc. etc. I am getting nowhere, and just want this item settled. Based on the forum I understand it is difficult to obtain a PFD from capital one. What is my next best option (paid as agreed?). Although this account is 5 years old, it is hurting my revolving credit utilization significantly. help?
Have your family member call and remove you as AU.
Then I would dispute as "not my account, was removed as AU".
If that doesn't remove it, then I would dispute with the OC, as FCRA allows, and ask them to prove the information they verified. If you search on this site you will find an OC Investigation letter that you can use.
If no results there, file complaints with the BBB, your AG, and their AG.
Thanks for your respons. The account has been closed for a few years. I have disputed with OC and they send back the general response letter stating they are going to continue to pursue and didn't acknowledge my request for proof. I will try your other options. I have asked my family member to request the PFD. I have also sent the my letter to the OC and their response to all 3 CRA's stating they have not sent any proof of the joint owner. I am seeking to the purchase of a home and this has been going on for 5 months. I am almost ready to pay them something just to get my utilizaton down. I need the points.
If you've requested information from the original creditor (Cap1), and they refused to acknowledge your request, I hope you kept their written response.
Given that you might be pressed for time, I'd contact a consumer attorney and file suit against Cap1 & the CRAs reporting for violation of the FCRA.
