Midland funding is reporting a collection account on all three CRA. I noticed on TU there is a open date of 03/29/13 and closed date of 05/01/13 but the status of this remains open. EQ and EX are not reporting a closed date. Can I dispute TU since it's not reporting accurately?
This is the same account that Midland Funding obtained a default judgment against me. Surprisingly, the judgement is not reporting to any CRA's. HLS (attorney representing Midland Funding) and I recently (03/15) were able to come to a settlement agreement where they would dismiss the judgment, close the account and report a $0 balance. It was agreed that I would pay 5 monthly payments with the last being on 07/31. The attorney emailed me the settlement letter via email. I contacted the attorney and informed him that I wanted to make one lump-sum payment on or before 07/31/15. He verbally said it was okay ( I know I should of have him send me an updated later). Fast forward to June 25, 2015 when I receive a letter from HLS informing me that their client (Midland Funding) would like to extend the settement offer of 5 monthly installment payments, with the last being on 11/30/15. I noticed in this most recent letter there is no mention of vacating the judgment, etc. What settlement letter is legally bindiing? Also, what should I do since this collection account is not reporting accurately on TU? Should I still make the lumpsum payment to HLS?
