I need some advise i have a Collection reporting on my account but i don't owe them any money or the original creditor and i have the invoice showing a 0 Balance from the original creditor, So i disputed it to EX and they closed the dispute and said the information is accurate so it will stay on my file, How can i get this collection removed ??
Asserted credit reporting inaccuracies should first be disputed under FCRA 611 before filing complaints or pursuing any civil action.
More explicitly, FCRA 623(c) prevents private civil actions relating to accuracy of credit reporting per se, and mandates that the consumer must first dispute, and provide the furnisher the opportunity to correct.
Dispute the collection on the basis that there is no debt in fact, and thus no delinquency upon which to base a collection.
Make sure to include your documentation of prior payment of the debt, as it will be the evidentiary basis for proving no debt in fact should they verify the accuracy of the debt.
The debt collector must then conduct a reasonable investigation and report back to the CRA.
If they verify, you can then pursue a formal CFPB complaint or bring your own private civil action under FCRA 623(c) on the basis that they did not conduct a reasonble investigation.
It depends upon the basis of inaccuracy asserted in the dispute.
Was only some item reported under the collection disputed, or did the dispute contest the accuracy of the debt per se?
