Greetings all, got a quick question,
I had a few collections on my CR a few months back that I felt were not valid. I disputed all 3, and they got removed. However, one of the CA, (a 300 phone bill) sent me a letter saying indicating they have my unpaid bill, and are sending the letter in accordinance with the law and that I have 30 days to dispute. This letter is identical to the one I received a very long time ago, leading me to believe that they are trying to start the whole process over again. Now, this Collections had only shown up on one of my Credit Reports (experian) and I do not want it on there again. I just now got my scores past 600, and I dont want to have to drop points again. What should I do at this point? I have 10 days until my 30 days are up, should I write them back demanding proof of validity it\\ and wait to see what they say? I honestly do not believe this debt is valid, but I would gladly pay the 300 to keep it off my report, so if I dispute it this upcoming monday and they send me proof of validity, if I pay the bill then, they wont report it correct? I had disputed this on experian a while back, and after about 4 weeks of investigation, they took this off my report. Im just trying to figure out my next move here, any help appreciated, thanks.
I am new to this and am still learning, so my apologies.
Send them a DV, CMRRR. Keep it short and simple. "In accordance with FDCPA 809, please send me debt validation on the above referenced account, which includes a copy of the debt or judgment you are attempting to collect.
Once they receive it, they can't report on your report, until they validate properly.
Do you disagree with the entire account or amount?
Ok, will do that tomorrow afternoon after work. Yeah, I do disagree with the amount. I'm about 90 percent sure I paid this thing off about 3 years ago. I had my cell account set up to shut down if my bill ever got about 150 dollars, so the 300 dollar bill seems unusually high to me. This CA seems shady, I've never heard of them before, and they don't even bother to spell my last name right when they write to me.
My main concern at this point is keeping it off my CR. Before it was only on my Experian, so I believe that is the only CRB they report to. After I send them a DV, CMRRR, and they do properly validate, you recommend sending a PFD immediately? With the couple of collections I had before, usually after validating a debt, they sent a couple letters trying to get me to pay before they actually reported to the bureaus. And I should avoid calling them at all correct?
Again at this point I do not agree with the amount, but paying the amount they want and keeping my report clean is the most important thing at this point. Thanks again,
B
