Collections on Credit Report from Divorce

 

My husband and his ex divorced Aug 2006.  They split the debt owed 50/50 as decided by the courts.  

She never paid her amount owed and there are 3 collectioins on my Husbands credit report that are for the balanced owed. (From early 2007)

 

We have send letters with copies of the Divorce agreement, but yet the CA's will not work with us.  They say the Debt is his and we must pay it.

Should we let them fall off our credit report?  Are these a possible PFD?  We're looking to purchase a home within the next 6 months and was wondering if this is going to affect us very much due to the age?

Any insight & info would be appreciated.

It is pointless to send copies of the divorce paperwork to the creditors. The creditors were not a party to the divorce and cannot be bound by that agreement, which was between the married couple.

 

Your husband should have kept current with all information on those accounts and resolved any late payment long before it went to collections. It will be far more difficult to resolve now since he has to undo the damage. From the dates, it seems she paid little if anything on the debts.

 

He can take his ex back to court for contempt of court. He can pay the debt and sue her for the damage. He can try both in that order.

 

There are lots of issues if he now buys a house. That will give the CAs something to lien after they take him to court and get a judgement.
