Are the account numbers the same? the address the same? everything exactly the same except for the DOFD?
I would be willing to bet that the first date on the first report was close to the actual DOFD and that it was then changed to keep it within SOL.
When you talk to you lawyer discuss them changing the date and see if it would be worthwhile bringing a suit against them for damages for altering the data as well as filing a knowingly false suit.
If they knew it was out of SOL, changed the date to show so, and then filed a suit, they knew it wasn't a valid claim...
IF the info isn't exactly the same (same account number, same company name, etc) then they will be able to claim it was for a different collection.
The account number and company name all look the same on both reports. They claim they picked up the account in 5/2009 on both reports. Here is the info that is different:
2011 -
DOFD: 6/2005
Date Major Delinquency First Reported: 7/2009
2012 -
DOFD: 2/2007
Date Major Delinquency First Reported: 6/2012
The balance they claim is also lower by about $300 on the 2012 listing...and is not what they are claiming in the lawsuit as the amount owed (minus the court/attorney costs they are adding on).
