So after my chats with @vntrsc this morning i did some more checking.
First s/he was right the SOL on this is 6 years. We have been going off 2 things. One the account that NFCU oddly wrote off but reported as Paid as Agreed. And two of the 3 lawsuits in 3 different counties. One said DOFD was Sept 2019 the other. For the same account but in a different county, says DoFD was July 2022.
All 3 cases were filed in all 3 different courts in diferent counties on the same day aug 31 2023.
All 3 lawsuits were dismissed by the courts for inactivity in aug 2024.
On April 22 nd 2024 the lawyer filed in yet ANOTHER court in another county. No summons no contact nothing to veteran who does not live in that country.
So if state court rules are followed on April 22 2025, a little more than a month from now, this case will be dismissed.
Our friend at court is Gong to try and look at the filings to see what it says about DOFD. Considering all the mistakes in filings so far the best I can surmise is that the 6 year SOL is up in either April 2019 or Sept 2019. Since he⁰ was in a coma from April on I am betting on April being correct.
I am going to have to find out the Paper of Record for that county and the state to make sure he doesn'try to NOT seve him physically and just serve him via public notice. I have already placed google alerts on his name bit with this latest discovered case I need to definitely monitor the Paper of Record.
