DV or Dispute first???

What is the first step for fighting  a collection on my CR? Do I DV the CA or dispute with the CRA?

Dispute with CRA is your LAST resort.

 

Start with DVing (at least twice) the CA.

As demed mentioned, dispute last. Disputing can cause bad things to happen.

 

Keep an eye on your SOL! Waking up a sleeping debt is a good way to get sued.

Ok, looks like I screwed that up as I have disputed baddies on Experian and Equifax.

 

Good thing is all of them are outside SOL.

 

Should I now wait for CRA's to report back from investigation and then start DVing, or should I start DVing now?

Unlike disputes, the right to DV has a thirty date time limit from the date of the formal collection notice.  YOu can only DV a CA, not an OC or a CRA.  I would DV right away.  You can also dispute with the CRA, or directly with the OC.

The consumer has a right to a 30dd to dispute debt from receiving the notice from the CA. The CA has an obligation to send a notice regarding the 30dd right within 5 days of initial communication with the consumer.

 

Communication with the consumer begins when the CA makes the consumer aware of the existence of a debt.

 

Now, if I find a new inquiry or a TL or a Collection  on my consumer report, I deduct that legitimate or not I have a CA on my back.

 

Unless I don't care about the credit scores, or I would rather wait the TL or Collection ages gracefully and goes out of SOL, I can take action as soon as I am aware of the CA actions.

 

Even if the CA commits a violation by not informing me within 5 days of the first inquiry or reporting to CRA, it doesn't mean I can't ask for DV.

I can ask the CA for DV AND notify the FTC\AG\BBB of the CA's violation.
