Do i have a case here? Please help..

So like was saying on the other posts. I’m trying to get a mortgage after filling  bk in Apr 2008 .I have student loans dating back to 2001 and I was in school until 2007..I was in school until August 30 2007 and on Dec 2007 I moved out of state. At that time I was still in forbearance because six month period was not up. So I called Nelnet in Dec 07 to let them know I’m moving and to update my info. Now fast forward to April 2008 I called them to find out if I can extend my forbearance because of job situation, I found out when I called that they are reporting 120 days late on 8 accounts, THE REASON according to them is that my school says I was in school only until  May 2007 not August 2007 because taking 2 credits from may 2007 to august 2007 (summer school) did not count as half time, which I did not know about it even when I called in December 2007.To make story short, I been fighting for two years to get the lates removed. Spoke to manager after manger at Nelnet, their answer is that I never called in December 07 to update my info and never got my request and they only way to remove this late  is to have the school submit proof that I was in school until August 2007 (which they wont) ..So im having no luck, I have 8 accounts from nelnet showing 120 late back in 2008 and im trying to get a mortgage, In April 2008 file bk, Nelnet is on my list as creditors. Can I use my bk to get those remove?, or is anything else can be done besides getting nowhere when I call nelnet and my school. Keep in mind first ever payment was required in October 2009 and never missed a payment. They refuse to admit that I called to change my  address and about my extension.. Any suggestions please?

If I understand correctly, you said the student loans were included in the BK?  Were they paid?

 

I was under the impression a student loan (federal) could not be included in a BK.

I included them in my bk.but im still paying on them as of now,,they were never discharged..I was just wondering if i can use that towards my advantage to have those lates removed somehow...

My reaction is no.

Prior reporting of derogs is not later erased by payment of the debt that led to the derog.

Except for students loans and child support.

 

Sometimes you can get the derogs removed after X months of problem-free payments.  You'd need to talk to the lender to see if they can help.

I feel like you should have a case here! I am going through a similar situation with Nelnet and am finding that they are one of the MOST unresponsive lenders EVER.

Out of 3 school loan lenders, they are the only one that did not update my address and never informed me that they reported me 90 days late. I coincidentally found out myself and had to contact them to pay the amount due. They are unwavering with any attempt to negotiate. It's not right that they do not update their records with correct addresses, then unapologetically report customers with serious defaults. Have you tried sending them goodwill letters?

Unfortunately, creditors generally have no duty to warn you or remind you of your contractual / financal obligations nor give you advance notice of CRA reporting.  If you do not get a bill, it's up to you to realize that payments are due on certain dates and / or notice the absence of bills.

 

I know nobody likes to hear it, but the excuse that one never received a bill is indeed weak.

You're going to need to provide some details about what you're talking about. I don't believe anyone has a clue what you mean by your post.
