Don't know what to do

Ok here's the deal.  I have a Discover Card charge off from 2000 that dropped off of my CR in around 2007 I think.   The thing is that I think Discover Card cannot report on this anymore since it has already came off and is like 9 yrs old but if I don't pay them can they send it to a CA and have them report it as a collection?  Would I be better off just paying Discover Card so I wont have to worry about something popping up on my CR out of the blue?  Thanks in advance any help on this issue would be appreciated.

Is it beyond legal SOL?

 

If so, I would not pay a thing on it unless you can PIF in one lump sum. You don't want to reset SOL and end up in court with a judgment because you can't PIF.

When a debt is past CRTP (approx.7 years from DOFD) the OC can sell the debt or the CA can sell it BUT they can not report it!!!

 

Keep all old copies from all 3 CRAs. These can be used if anyone starts reporting it again.

Thanks for replying.  The problem is I didnt keep any records of past CR's until just recently so I have no documentation proving that it was ever up there.  The only thing that I do have from Discover Card is the monthly bills they send to my mothers house and it mentions at the top that I have been a customer since 2000.  So if they do decide to report later what can I do?  Could I try to get documentation from Discover Card so I can keep for my records?

Just to clarify.......this is unpaid? Still owned by Discover? Went delinquent when?

 

CRTP goes from DOFD not date opened.

Yes it is unpaid.  It was opened in the beginning of 2000 and charged off around the end of 2000.

When it past the SOL, they won't win the court suit and your not obligated to pay this item. Also from 2000, it shouldn't even pop back up on your report. You should be good and if anything does pop back up, you can call or write to the CRA stating the item is Obsolete.

I always keep all my old CR's anyway.  I have 4 folders....one for each of the 3 & one for GW's & such that affect all 3.  I have old reports from 95 & up!  It's nice to see where I was (yuk) and how far I've come. Plus, having old ones is a good thing in case you need verification of a debt paid or removed.
