Dynamic Recovery Solutions and odd DOFD

So I have a new collection on EQ Smiley Sad Dynamic Recovery Solutions, and the OC is Checksmart. It was reported 7/2015 with a DOFD of 10/2014.

Roughly 7 to 10 years ago, I was stuck in the payday advance loop and routinely got advances from Checksmart. So I was a customer at one point. I got my last advance probably over 7 years ago, and can't recall if I ever paid it back or not. There's a good chance that I didn't, since at the time I was going thru a foreclosure and moved across the country.

My question is .. how can they have a DOFD of 10/2014 when I would have defaulted no later than 2008? I started a dispute on EQ's website immediately after learning of this .. should I do anything else?

Re: Dynamic Recovery Solutions and odd DOFD

Instead of disputing I would have sent them a Debt Validation letter if you live in Texas. If you don't live in Texas, and you were still within the time allowed to do so, I would have still sent a DV letter. Also, check the SOL in your state for debts. I wouldn't have disputed first because your score will tank if it comes back verified. I've made that mistake before I learned how this works. My guess is they don't have the proper documentation to verify the debt. I get zombie collections for super old debts all the time. I just ignore them (they aren't on my credit though).

I can't see how this can come back as verified with a DOFD that's off by at least 7 years...

Re: Dynamic Recovery Solutions and odd DOFD

They do it all the time. They don't really have to prove it to the CRA. I think that's how they are able to do that. They do have to prove it if you send a debt validation letter.

Re: Dynamic Recovery Solutions and odd DOFD

So if it comes back as verified and my FICO takes a hit, can I still DV which should result in it being removed from my CR?

Re: Dynamic Recovery Solutions and odd DOFD

I know in Texas you can send a DV letter whenever. In other states I believe the laws are different. I think there is a specific time frame you have to send a dv. Did you receive a dunning notice from this collection agency? You can also file a BBB complaint. I did that to get a collection removed. I never received a phone call nor dunning notice. It just appeared on my report and I wasn't even positive the debt was owed. The company responded that they would remove it and they did. I'd start with a DV if you are still able to do so in your state. I'm hoping other seasoned members chime in.

Re: Dynamic Recovery Solutions and odd DOFD

I'm in FL.

I've never received anything from this collector, and AFAIK this debt is beyond the SOL for suing and the DOFD should be at least 7 years ago (not last year as they have listed on my CR).

Are you certain you are seeing a DoFD and not the "opened" date?

Re: Dynamic Recovery Solutions and odd DOFD

I'd say you have a good chance of getting this removed. Re-aging a debt is a serious violation. If the dispute doesn't work. DV them.
