False Debt

Well this story is kinda long but i'll keep it short.

 

I Purchased a Gym membership last year March, Agreement was for 14 Months for 1 Year worth of payments in-advance.

Made agreement to pay 50% in cash on day of contract and the other 50% within 30 days.

 

Skip forward 2 weeks later, I pay my other 50%.

Skip another 3 weeks, I try to enter the gym and the receptionist won't let me in saying I was due the other 50%.

Talk to General Manager and he told them to put a note and that he would call corporate to fix it.

 

I kept going in and eventually I wasn't let in again. This time the General Manager gave me a note saying I should be let in until further notice,ect. Signed by him at the end.

 

Everything was cool, I eventually stopped going for like 3 months and on January I noticed corporate "sold/transferred" my debt to a collection company and is being reported on my TransUnion report. I got in contact with the gym and was told the General Manager was laid off and they had a new one. This time I decided that I should scale this up because now It is affecting my Financial Life so I got in contact with a Regional Manager and I showed him proof of my second payment (Debit Card) and he told me he would file it to corporate and that next week (January 20ish) it would be taken off and gave me his phone number. Jan 27 passed and I called him, he told me he was awaiting corporate response still and that by early Feb it would be solved and he would call me no later than 2 weeks.

 

Feb 12 arrived and I called him since the 2 weeks were due and now he told me it was fixed. To go on Monday and that he would give me a extension for all the trouble and to get the documentation of the collection being taken off already. This monday I go to the local gym and surprise... he wasn't there. I called him Tuesday and he told me to hold on that he was on a meeting and would call me within a hour. Nothing, I went to my credit karma and noticed the collection agency reported it for the month of February as due still. So now I know he is playing circles with me.

 

So at this point I know that I probably have to go to a Lawyer but I wanted to know if anyone knew what the exact process would be to take this off my credit; I don't even want the membership at this point.

 

I forgot to mention that the debt collecting company looks like a really close affliate based on google searches and that a previous employee told me that corporate still had access to the accounts "sent" to that collection company.

While it most likely willl not resolve your issue, I highly recommend that you file a dispute of the asserted debt, which will require the furnisher (gym) to conduct an investigation and make an official determination as to the accuracy of their reporting.

If they verify, that wil open your ability to seek civil action for lack of reasonable investigation of your dispute.

Otherwise, you will have not recourse to private civil action under the FCRA asserting willfiul or negligent reporting.

 

They may, when faced with a required reasonable investigation and either verification of accuracy as reported, or correction or deletion, choose to delete the reporting.

Otherwise, you will have set the table for civil action.
