After months if calling and disputing I finally got through to Capital One!!!!!! Below is part of the letter that sent me,
In addition, I have sent an update to the major consumer reporting agencies to remove the delinquencies reporting
for the months of December 2011 and February 2012 from your credit profile. As all credit reporting is processed
electronically it may take these agencies up to 90 days to update their records. In the interim, this letter shall
serve as verification to any parties that may be interested in the outcome of this matter.

On 3/3/13 I filed a complaint with the BBB and in the complaint it asked me how would I like for this issue to be resolved. I put for my 2-30 day lates to be removed from all credit reporting agencies. I received the email today!!
