I think you would have better luck just trying to get the whole trade line removed... 39 lates is quite a lot of 'ignoring'
I think it might be too soon to get a successful goodwill, but it doesn't hurt. I would stress that 4000 dollar buy off payment as proof you were willing to make due on your obligations even after hardship. They might be into that

I agree, 39 lates will be hard to get GW'd off. If you cannot get them removed, then getting the tradeline removed will be your best bet. 39 lates will absolutely destroy your auto-enhanced FICO.

Be really careful. Cap1 goodwill waived a bunch of fees for me because they screwed up. But they didn't change the lates. AFter I paid them off, I went to my customer advocate who helped me and she recommended to the credit department to remove a bunch of the lates. Well, they came back and added lates that weren't showing up on my bureau (because they weren't late, but were their tacked on fees etc.) So I went to a supervisor and they changed the data to again erroneously reflect that I went from current to 90 days past day in one month then to 30 days past due, then to current all in a 60 day period.
So.. I wrote to the executive office for relief. Got a bunch of ass-covering up the line and they refused to correct the mistakes, saying it was my fault that I relied on the information from their account representative that I didn't have to pay all the accrued late fees in one month. (they had offered 8 months to pay them, I paid them in 3)
If it can't get worse, then do the goodwill. If there is any way it can get worse, they will likely make it worse.
I had more than $75,000 in a cap1 checking account and generated more than $1,500/month in trading fees with them and it made no difference.
