Help with Pinnacle Credit Services

Below is the complaint I just submitted to the BBB. Is going via BBB the right step at this point?

On April 3, 2008 I sent 2 letters to Pinnacle Credit Services (they have 2 addresses listed on my credit report, which I believe is in violation of federal law) via certified mail, return receipt requested, asking for validation of a debt listed as a collection account on my TransUnion and Experian credit reports. Pinnacle Credit Services received my request for validation pursuant to federal law on April 7, 2008.

On April 15, 2008 Pinnacle Credit Services listed a delinquent collection account on my Equifax credit report. As such, Pinnacle Credit Services continued to attempt to collect a debt that had been disputed by the consumer without providing the requested validation.

On May 13, 2008, I sent a dispute to all three credit bureaus regarding the account listed by Pinnacle Credit Services.

On May 19, 2008 the account was removed from my Equifax credit report.

On May 21, 2008 Pinnacle Credit Services verified the account to both TransUnion and Experian.

To date Pinnacle Credit Services has not responded to my request for validation.

Maybe I should have also noted that they "updated" the account on TU and EXP on April 21 and didn't list it as disputed. Now that I disputed with the CRAs it is listed as disputed. Am I correct in thinking that they are just racking up violations? Should I also file a complaint with my state's AG? Should I also have noted that they never made any other attempt to collect other than listing to CRAs?

Pinnacle will not validate, they will forward it to another firm for validation, that firm will contact the OC and then forward you what that firm was sent by the OC.
 
I think it is BS myself,  If Pinnacle CANNOT validate, then why the hell are they reporting with the CRA's.
 
I am going through this right now too. They forwarded my DV to Nelson, Watson and Assoc.
 
Pinnacle is acting like they are the OC which they are not.
 
I am about to get pretty nasty with them if this DV comes back the same way.

                          If this was on your CR when you sent the DV....they can continue to report for 30 days. IF they do not validate they must stop reporting until they do!

                         Their 30 days were up May 7th.     Now you can send the 2nd DV letter OR just send the CRAs the letter asking to have it deleted.....OR both

I never send the second letter ....I just go for the CRA

 

Send this letter  along with a copy of the DV letter...copy of the cert paper & GC......it is sent by fax or CMRRR

read and make changes where needed

This is a request for deletion of a disputed item. I have attempted to have this allleged debt
verified by the alleged creditor and collection agency to no avail. I am respectfully requesting that
"Collection Agency" do what is legally mandated by the FCRA and FDCPA, and delete the account listing.

On XX XX 08, "Collection Agency" received a demand for validation from me. Attached is a copy of that letter along with the U.S. Post Office return receipt showing they did indeed receive the request.
 
 
As of today, XX XX 2008, they have failed to provide any proof or respond in any way.
On XX XX 08, I sent a second letter. Again, I have received no response. Attached is a copy of the
letter and the U.S. Post Office showing they did receive that letter.
 
The FDCPA states they must cease collection activity until they have produced verification of the
alleged debt if so requested. As per the FTC, this includes reporting to the credit bureaus, which
they obviously have done illegally. It is quite evident that no such proof of this alleged debt exists
or they would have provided it in the previous X months since it was requested.
 
Also, when an alleged debt is disputed, a notation must be entered on the debtors report showing the
item as in dispute. Again, this was not done. Another violation of the FDCPA. (DELETE THIS PARAGRAPH IF IT DOES NOT APPLY!!)
 
As per the FCRA, if no proof of debt exists, it may not be reported to the credit reporting bureaus.
The FCRA also states that the credit reporting agencies must accept written proof from the debtor.
Therefore, I am not asking for an investigation to be done, I am requesting that the entry be deleted
in its entirety as there is no proof of its existence as evidenced by my attached documented proof.
