Help with dealing with BMW FINANCIAL SERVICES

Hello all, I have lurked this forum for many of times & it has helped me tremendously with rebuilding my credit profile. I decided to actually join your ranks here because I am in a situation that I have read many times before but mine is a little different.

 

I took out a auto loan with BMWFS back in April of 2014, at the time I was banking solely with my credit union & set up automatic payments to be sent to BMWFS as well as auto deductions from my payroll check. I decided to refinance with my credit union in June of that same year because I couldn't pass up a 1.9% interest rate compared to the 4.9% BMWFS was giving me. Fast forward to February  2015, I started banking with Wells Fargo, I ended all auto payments with my CU & switch them over to Wells Fargo. The auto deductions stayed present with the CU as terms per my contract in the refinancing of my vehicle. This is where my problems begin, somehow someone at the credit union never sent my payoff check to BMWFS & the money was still being deducted from my payroll to pay off said loan that I had with my CU. My car was repossessed in May due to non payment by BMW, I immediately contacted my CU to figure out how this happened & thats when they explained to me that they were having problems with the banking system. I fussed & they ended paying the fees to reinstate my loan with BMWFS & get my vehicle back. I spoke with a rep at BMWFS & was told if I faxed over a letter from the CU explaining that this situation was entirely their fault that BMWFS would clear the negative remarks from my Credit Report. Me being foolish, I believed this would be true. Bringing us to the present day, the car has been paid off the car in full due to a insurance pay out, & I went to finance another vehicle through BMWFS & they say I’ve been denied due to the prior repo. I’ve shown them copies of the contract with my credit union to show them that I was led to believe that the CU would send them a payoff check & my pay stubs from that time period to show that all payments were made to them due to a my payroll deduction. They keep throwing the missed payments & repo in my face as to why I’m being denied. All the while the repo only took place because the negligence of someone in my CU. Even with a letter my BMWFS account analyst is not budging. I have been drafting a Good Will Letter template over the past couple of days to start sending out to plead my case/ try to reach someone other than the phone reps. Do you guys think this is a complete waste of time or shall I keep fighting? I have raised my credit score from a measly 589 to a 671 since the beginning of January with the advice I’ve received from this forum, so any help would be appreciated.

Is the repo showing on your report?

Once when I had Honda Financial there's was a mixup with my auto pay. For almost 6 months they deducted my car payment from another person's account at the credit union. And then all those payments were reversed by the credit union because they were authorized. I never was contacted nor did my statements reflect anything unusual, not even the one leading up the mess. One day at work I received an email saying my online account was closed. I imediantly called and told my car would need to be handed over or it would be repo'ed. I was furious to say the least. I paid the balance due which was around 3k to bring it back to current. They agreed to let me keep the car and I would need to pay my payments each month to their collection dept. It was also reported to CAs and dinged my credit. I was prepared to fight them tooth and nail. I called them and demanding they reinstate my account to the original status and remove any negative remarks or I would sue (I wasn't kidding). It took about a week and calling, but finally I prevailed. And then I dumped them and refuse to every use them again. I've used BMW financial once and nerve had any issues. Sometimes you just have to play hardball.

Yes the repo does show up on my report, I recievd a email from BMWFS this morning actually giving instrucrtions on how to dispute the credit app denial. Basically they told me to submit a Good Will letter explaining in detail what happened & that they would go from there.

Well guess it couldn't hurt to try and see what happens. Hopefully they do the right thing.

Also keep in mind that you defintely want is off your cerdit report bu this might not help you with BMW.  Alot of institions keep internal records of accounts, so if you have a bad dealing with them in the past they may deny you in the future regardless of what your credit report says.

Yes I thought of this too, but this is why i'm not just asking them to remove it from my credit report but i'm proving to them that this was not my doing. I had no control of the situation at hand. So hopefully they see that & atleast attach all of the information that i'm giving them to my internal file

UPDATE****

 

Well i finally got word back from BMWFS. They basically told me to kick rocks for lack of better words. They claim that even though I have shown proof that the CU put me under contract for a vehicle loan, it has nothing to do with them. They also gave me some legal advice though, they said being that the payoff check was never sent out, that the CU contract is null & void. That I should lcontact a lawyer & gt back every cent that was taken out of me paycheck (which totals about 15,886.00) due to this ficticious loan. They also said that I should fight for compensation due to my credit being wrecked because of this.
