I can see the light...(satisfaction of judgement)

...but it's starting to dim Smiley Sad

 

After a 5 year long process of rebuilding my credit w/ the help of advisors, attorneys, and utilizing MyFico and other similar products, I am now in the position of purchasing a home.  My wife and I currenly live in a small starter home that we had purchased under her credit 9 years ago.  While it's a nice home, we have a growing family, and needing to upsize.  While my wife's credit is still nearly perfect (I didn't let her follow my poor judgement when I was young), mine is FINALLY to the point where we can purchase a new home and have both of our income count.  We both have great jobs, and can afford a new place after eliminating basically all debt sans a 5% debt/credit ratio on a few CCs that helped me build my credit.

 

I had 2 judgements that needed to be paid (store retail cards I acquired 15 years ago), and these have now been paid off and settled w/ the help of an attorney.  Our mortgage broker has stated that we are prequalified to purchase a new home pending the satisfaction of these judgements (don't need to be vacated, just shown as "satisfied or paid").

 

One of the creditors updated the case immediately, and had the satisfaction of judgement completed w/in less than 48 hours of getting paid.  The other creditor (Midland Funding), has yet to file for satisfaction.

 

I have attempted to speak w/ my attorney, but I feel that he is getting tired w/ my calls.  If anyone has been in similar situations...how long did it take for you to receive a letter of satisfaction, or have it updated w/ the court?  I live in MO, and attempted to find the answer myself in terms of how long the creditor has, but haven't found much info.

 

Any info would be appreciated.  I check the court's website every 10 minutes just hoping that it will be the moment it's finally updated.  Just wondering if someone out there has been in the same situation and could help ease my anxiety/OCD regarding this.

The time period to file a satisfaction with the court is 30 days from the date its paid off.

That time period has elapsed.  I guess I'll have to continue to bother my attorney on why this hasn't been resolved.

I disputed my fiancee's account with Midland because they took over 2 months to update...as soon as I disputed within about 3 days it was updated. I tried the whole approach of being nice and calling them but everytime I called Midland had no problem making me sound like a dumb-butt so I figured I am sick of waiting and hoping to have it updated so i disputed...

Check the rules of civil procedure for your state to obtain the requried period in which the prevailiing plaintiff is required to file the notice of satisfaction with the court.

If that period has expired, then send your proof of satisfaction to the office of the clerk of the judgment court, requesting they record or contact the plaintiff regarding their failure to comply within the required period.
