I messed up

I am attacking my credit with full force and have gotten several baddies removed in the past 2 weeks by doing PFD. I messed up with Asset Acceptance.

 

Here is my mistake. I called Asset Acceptance and recorded the phone call on 8-6-09 (it is legal to record phone calls in my state as long as one person knows it is being recorded)  I verbally offered to PFD and made it clear I did not think I was responsible for the debt as this was a Southwestern Bell bill from my ex-wife.

 

I have 2 reps from Asset Acceptance on the recording agreeing to the PFD.

 

On 8-17-09 I called back to check the status and was told they would not delete the TL and would only update it as paid. This phone call was recorded as well by me. I informed them that the agreement was to PFD and that updating it to paid does me no good and I would not have made payment on a debt I did not agree with if that was the case.

 

Long story short, I messed up!

 

I sent this letter via email last night and I am going to send this letter CMMR to them and hope for the best. I guess my options are the BBB and State Attorney General if they fail to remove the TL. I do have them on recording agreeing to the PFD.

To Whom It May Concern:

This letter is to inform you that the validity of this debt was disputed during a recorded phone call on 8-6-09.

 

In the spirit of compromise, I offered to pay this account IN FULL if you agreed to the deletion of this account from any and all credit reporting agencies (Equifax, Experian and TransUnion). The purpose of this settlement was merely to have this item removed from my credit files. It was not to be construed as an acknowledgment of liability for this debt in any form.

 

You verbally agreed to the terms and accepted this agreement during the phone conversation on 8-6-09, This conversation was recorded by myself and payment for the full amount of $348.38 was made by me in exchange for full deletion of ALL references regarding this account from my credit files and full satisfaction of the debt.

 

On 8-17-09 I again called your company to check the status of the account / deletions. This phone call was again recorded by myself. During this phone call I was advised that the item would not be deleted from the credit reporting agencies, as promised during the 8-6-09 recorded conversation. I was now told that the account would simply be updated to show it was paid.

 

I made an immediate and full payment in the spirit of compromise to your company and followed through with my promise to pay in full even though I still dispute the validity of the debt. Now I am asking for you to follow through with your promise to delete this entry from all credit reporting agencies.

 

I trust your companies word and will assume at this time, that a misunderstanding during my 8-17-09 call occurred. I trust that your company will honor it's commitment to me and will promptly remove this account from the credit reporting agencies as promised.

 

At this point I only want what was promised, which was the removal of the item from the credit reporting agencies. I have NO desire to contact the Better Business Bureau and/or my State Attorney General at this point.

I got a call back from a very nice gentleman who advised he listened to the tapes and there was some confusion as to what was to be done. He agreed to remove the TL from my reports today and to send me a letter stating such! Awesome news!

Success---way to go! taking issues head on is the only way to go. Keep it up.
FICO scores on November 17, 2014 (prior to applying for and being approved my mortgage)

EX=738
EQ=735
TU=754

FICO scores on March 4, 2015 after being approved for mortgage and buying the home, the mortgage isn't yet reporting.
