IC Systems not reporting yet?

OC is Chase that is reporting a closed account with a 1100 balance, currently at 150 late. During the past 150 days, they will not allow me to talk to their CSR on the phone, let alone make a payment to them. They say I have to talk to the "department now handling my account" - IC Systems. But - it's not a chargeoff, and the balance is NOT at $0.

 

CA (IC Systems) is not showing on any of the CRA - I use Transunion to pull my reports about once a week (OCD I know.) I have blocked their number as "spam"  on my cell phone so they don't bother me...the "block" expired a few days ago and I started getting a call every hour starting at 7am, they are relentless.

 

I don't have the money to PIF...I can afford maybe 200 at MOST if I pay at once. And I'm in WA - 6 years is the SOL.

 

What's the best way to handle this situation? I tried emailing and calling Chase, they refuse to talk to me. I don't want this to show up as a "surprise" in 5 months...trying to handle other bads on my reports so I have a clear report and don't want this issue to drag me down at the end.

if the OC has hired a CA to conduct collection activity on their part, that is what they are paying them to do.  The OC can choose to refer inquiries to the CA, even if the OC still owns the debt.

The CA is not required to report to your CR in order to conduct collection activities.

You can do two things to block their current collection activities.  Did they ever provide you proper dunning notice?  DV them, thus giving you a temp block in their collection activities.  To gain a stronger, and permanent cessation of their communications with you, send them notification under FDCPA 805(c) that they shall no longer communicate with you.

Wouldn't those actions make them more likely to initiate a lawsuit to collect? I'd be happy to set up a payment plan, but I don't want to wake a giant that could otherwise just disappear in 5 1/2 years. 

 

And no, no notice otherwise.

I cant advise you on what a CA may do, only on what you can do.

I would send the CA the following letter:

 

"This is a request, under FDCPA 809(b), for full validation of the debt you have been contacting my in regard to. (provide as much identification of the debt and their contacts with you that you have).

 

"My ability to request debt validation is seriously impaired by your failure to have sent me the legally required "dunning notice," mandated under FDCPA 809(a), within five days of any intial communication with me.  You have initiated, and continue to initate, numerous contacts with me that are much prior to five days ago, without compliance with your notification of my rights under FDCPA 809(a).

 

"As you are aware, you are now requried under FDCPA 809(b) to cease all further collection activities until such time as you provide full debt validation to me, in writing."
