Identity Theft Complaint and Affidavit Questions

So my mother, who passed away in 2013, opened an Entergy account in my name without my permission.  There was a $158 balance left on the account.  I found this by checking my CR.  I called Entergy to see if they could provide dates of service to see if I can find the lease documents from the places we lived in Virginia so that I could provide proof that I didn't live at that address and didn't benefit from the services.   They were unable to provide me with the service dates and information because was around 5-6 year ago.  I'm not sure what to do next.  I kind of need those dates to finish filling out this form and to have a clue where to start tracking down those needed documents.  I've sent emails o the various apartment complexes we lived in while stationed in VA but as I said that was 5-6 year ago and I'm not sure how far back their documents go.  Any suggestions on what to do?  Come to find out she put it in my name at a different address in AR as well but at least that address was left with a $0 balance.  I haven't lived in Entergy AR service area since 2001.

Are you attempting to put together an identity theft affidavit for the purpose of blocking information from your credit report under the provisisions of FCRA 605B?

If so, then the primary substance of both the affidavit and and police report is a sworn assertion, not proofs.

 

The primary purpose of the identity theft process under section 605B is to avoid need for proofs, and rely upon a sworn statement before law enforcement, which carries criminal penalties for any false statements, as sufficient to obtain credit report blockage.

Are your effforts at prooffs for some other purpose?

I called Entergy and they are sending some form for me to fill out and asks for proof that I didn't live at the service address.

Ok. If that doesnt get it taken care of then as Robert says you would need to use the ID Theft laws in the FCRA to get the entry removed
