Key Bank - Any truth to this statement

Awhile back, I had problems with EQ deleting my accounts in good standing, they told me to ask the OC's to put them back if i wanted them replaced because EQ would not do it. Well i asked Key Bank if they could replace it on my EQ report and the answer i got is as follows and I quote. {We are unable to begin reporting this account to the credit bureau's again. We are required to delete any accounts that are older than 7 years and contain derogatory information such as late payments] This account had 2 late pays back in 2003 that both fell off as of either november or december 2010  After that date none of the CRA's listed any late payments on the account and TU and EX do not show any lates, so I am just wondering, is this a legit excuse not to put it back on my report when it shows no lates or just another bank not doing what is right. Thanks in advance for any imput. TU and EX are both still reporting these accounts and Key also said they never instructed EQ to remove them, they just can't report them again.

Thank you for the reply AndySoCal, I thought where the lates fell off and TU and EX are still reporting, Maybe I could get it put back. I tried, Thanks again for the input
