Hello all! My first time here so hope i post this right. Ive been building my credit for the past 2 years, and recently had to purchase a truck as my old one died. Im building my credit so i can refinance it in a few months as i had to settle for a really high APR as nobody would loan to me. I have a loan thru Affirm that i have nearly paid off, and was looking forward to it boosting my score, but i recently checked the details on my report, and found that it hasnt updated payment information since September of last year (even though i havent missed a payment and have made extra payments as well) So i now have a $600 dollar loan sitting on my report showing no payments when its almost paid off ($10 left) Should i give it another month or is it time to file a dispute? Im trying to boost my credit into the 680s so i can apply for a premium card with a high CL and benefits so that can boost my score into the 700s so i can go for the refinancing.
Once information has been reported to a CRA, the furnisher therafter has the responsibility under FCRA 623(a)(2) to "promptly" update the information so as to maintain its current accuracy.
No explicit period in days or weeks is provided, so the statutory period for requried update is interpreted using a reasonableness standard of law.
A reasonable interpretation of "promplty" would be in their next regular reporting cycle. Accounting for some necessary admin processing, which might delay a payment from being posted in their next regular reporting cycle, a reasonable interpretation would be, if they update monthly, that the information be updated within two months of payment.
At three months of lacking update, it is clearly, in my opinion, ripe for dispute as not meeting the requirement of promptly being updated.
