Hi,
It's been a while since I've been on this forum daily, but I'm hoping I can get some helpful advice like in the past. I just recieved a Pre-Legal notification from Midland Credit Managment.
A little background: For many years I worked for my uncle and ran my own side business...I got really interested in building my credit pretty young and had got some quite good cards and limits and so on. My uncle suddently had to move because his wife had serious medical issues in which they had to go out of state to be near a specialist, and my own business really tanked for a few months right during that time - a perfect storm!
All the positive credit accounts I'd aquired and work I had done to build my young credit over the years since turning 18 had been absolutely crushed. I ended up salvaging a few accounts (but with the credit scars to show for it) and a handful were closed and went to collections.
Althought I get a lot of mail and phone calls from various different accounts, at this point the only one seemingly reporting as a collections account on my credit is Midland Credit Managment.
I'm not sure what to do as a first step here, as I've never dealt with any collections or anything like that before. I'm honestly not even sure what info I should post in order to help you guys help me, aside from who the creditor is?

Midland Credit management Inc. Has made several attempts to contact you regarding this account. This letter is to inform you that we are considering forwarding this account to an attorney in your state for possible litigation. Upon receipt of this notice please call 800 939 2353 to discuss your options. If we don't hear from you or receive payment by 02 24 2018 we may proceed with forwarding this account to an attorney.
Some possible options:

I know I've seen somewhere that you can do pay for delete agreements and all that, but what would be the best course of action at this exact moment for me? I obviously dont want to get sued and I would love to get an agreement set up to where I could have the entire account removed from my credit somehow, but I'm not sure what to do first...?
Any help is GREATLY apprciated!
While MIdland is appearing strong-arm in their recent communication, they have a publicly posted policy that makes them one of the easiest debt collectors to obtain a PFD deletion.
If it has been at least two years since the DOFD, they have a posted policy that they will delete any reporting if you pay the debt and at least two years has passed since the debt became delinquent.
Can you make them a PFD offer?
Would I base the Date of First Delinquent on the original account or the collections account date showing on my report?
It looks like the first 30 day late (on my Experian report) for that account is Sep 30th 2016.
It also looks like March 29, 2017 for the Midlands Collection account for that original account...
DOFD goes by Original Account. It doesn't matter how many times it was sold off, it goes by the original date. Are you gonna pay in full or settle? Normally, if paid in full, they will delete. If settling, still try to get the PFD. If they won't budge, send goodwill letters after. But I'm sure they will delete it. Most people have with them.
Based on my experience with Midland Funding aka Midland Credit Management I'd advise paying the debt or they will file a suit if you don't make an arrangement with them, ask them for a PFD I did and they approved it even with making a payment arrangement so long as it was for the full amount and I met the terms of the payment arrangement.
In my case my original debt was with Credit One Bank, who after paying off Midland I contacted Credit One's executive office and they agreed to remove the chargeoff completely from my credit report as they no longer had a vested interest in the account. It took me about 6 months to get all of this done but it is possible, and given your deliquency is also the result of a hardship similar to how mine was you are more likely to have it removed as a goodwill gesture if you resolve the deliquent amount. Just my two cents though.
See if your Sync account has an arbitration clause and elect arbitration. They will not do arbitration.
Okay thanks for that info. Is it best to write to them so its all documented? Is there a way to email or chat through their website?

What would be a good offer? Pay the entire thing and request it PFD? Pay partial and request PFD? How much is normal? Should this be soemthing I write out and mail in or what?
