Medical Collection from bankrupt Hospital. What To Do?

CA called about a debt from 2005 (past SOL) and if we'd be willing to make a payment. We responded with, "we'll call back when we're ready". We basically took ownership of the debt.

 

Now we find out 2 days later that the hospital went bankrupt and closed. We tried to call and they told us all debts are forgiven because there is nobody to pay.

 

The CA never sent any letter notifying us of the 30 day period to DV. I would obviously win a DV since the OC is no longer. I'm wondering if we forfeit our right to DV since we verbally took ownership of the debt over the phone? Does anybody know the policy on this? Can we DV this?

 

CA is CAPIO.

No, you don't lose your right to DV by what you did.

 

Is the CA reporting on your reports?

 

If so, I would ask Fused if you should follow the HIPAA process or DV.

 

If not, then I think you could DV, as this would keep them from reporting(if they follow the law) until the do validate and the HIPAA process is about the reporting of a medical debt, so don't think HIPAA would work if they are not reporting.

Yes they are reporting it. They called Friday 3/5, the hospital closed in Mid February, my report says they've been reporting since 9/2008 which is not true.
