Yeesh, Fused, EVERY SINGLE medical collection I have (and one that hubby has) all shows the original creditor. In my case, I have 4, one of which is paid. In hubby's case, the one reporting is paid.

It's been like this as long as I can remember. And we just sat around, doing nothing about it. Smiley Sad

Great!  4 of my collections say the OC name, the other 2 are masked.  All are med. collections.  I cant wait to hear the outcome of this.

Me, either!! A new one was placed on my CRs about a month ago and it's one of the guilty ones!!

I'm also very interested....In my case, I have 3 medical collections. On Eq and TU, the OC is listed. On my Experian directly pulled online from Experian I don't see the name of the OC, HOWEVER, my pull from MYFICO for Experian does have the OC name on the report.

CAs are not suppose to list the OC's name on credit reports, it's both a HIPAA private health
information (PHI) violation and a FCRA violation. Again, please wait until we get back with you. We need to discuss the judgment aspect in all of this.

§ 605. Requirements relating to information contained in consumer reports [15 U.S.C. §1681c]

(a) Information excluded from consumer reports. Except as authorized under subsection

(b) of this section, no consumer reporting agency may make

(6) The name, address, and telephone number of any medical information furnisher

that has notified the agency of its status, unless--

(A) such name, address, and telephone number are restricted or reported using

codes that do not identify, or provide information sufficient to infer, the

specific provider or the nature of such services, products, or devices to a

person other than the consumer; or

(B) the report is being provided to an insurance company for a purpose

relating to engaging in the business of insurance other than property and

casualty insurance.




Fused~ I too am a victim of this.  Is there a letter out there that I could use because this also has tanked my scores.

First.........NEVER talk to or contact a CA about any medical debt!!!!!!!
 
Everything listed by the CA  with this info. is a violation of HIPAA law!!!!!!!
 
Your first step id to file a dispute with the Per-HIPAA  letter!!!
 
Then wait for the dispute to close!!
 
Step # 2    send the OC  the HIPAA letter  with the correct insert.....paid or full payment ...or not mine....which ever fits your need!!
 
federal HIPAA law states that the CRAs must contact the OC not the CA  to obtain the correct info.
 
As we all know this is not always done....I would call the OC and ask for the complete amount owed on each account....they can NOT be combined!
 
This way you know the amount is correct & you can use the letter to the OC to PIF
 
It is up to the OC to delete the reporting of the CA...............There are more letters available but you should not need them......................let me know if you do!

Your furnishing of my account information to (collection agency name), is not in compliance with HIPAA,or (name of your State}'s Privacy Act, and any subsequent reporting of this account on my credit reports to (credit reporting bureaus) is a clear violation of Public Law 104-191 ("HIPAA") since there can be no permissible business purpose in divulging protected health information to anyone on an account once there is no longer any payment due.

You are required under the FCRA and FACTA to accurately report the status of any account to the credit bureaus, and you are prohibited under the HIPAA and State privacy regulations from doing so on a PAID account, as there is no longer any permitted business purpose.

Therefore I am requesting you promptly rescind all such account information furnished to (collection agency) and require them to purge their records of all reference to this account, and that you insure that any and all reporting of this account is immediately deleted from my credit reports.

As to the judgment........I am not an attorney so I can only tell so much.
 
First   any personal info.  mention of hosp. Dr. or anything related to health condition is a Violation......it doesn't matter if it is reported in a judgment or CR by a CA!!!!!!!
 
I would first....call the courthouse and pay for a certified copy of the judgment!!  You must have that.
 
I would check out good lawyers that have handled cases of HIPAA violations!!!!!
         This is a Federal volation & needs to go to federal court where it will have a bigger impact!
 
HIPAA has more power then any other LAW!!!

Thanks for all the help.  But which letter do I send as I already disputed with the CRA's and they came back as VERIFIED.  This is how it appears on my cr's:
