Midland dispute

First post. I've been reading these boards for a while now in an attempt to rebuild my credit. Wish I would have started reading these a lot sooner!

 

I've been sending GW to Cach in an attempt to have that collection, which I paid, removed. No luck yet. I also have a collection from Midland from the same time. After checking my reports the original balance was $1,368 but the amount due is $1,528. Would this quailify as them adding additional fees and be grounds for the collection to be removed? It is scheduled to fall off in two years. I don't want to do anything that would reset it. Any advice would be greatly appreciated. Thanks!

The governing statute is FDCPA 808(1), which specifies that a debt collector may not collect or attempt to collect and amount, including fees and interest, that were not specifically authorized in the account agreement that crreated the debt, or otherwise permitted by law.

 

Most OC account agreements will include some provision of interest on delinquent debts.

The first step is to dig out your account agreement and review what it authorizes.
