Military deployment and serious deliquency w/cap 1 cc

 

My son deployed with his team to the middle east this past fall. for 6 mos. He was married a week before he left and somehow his cap i cc payment details never got communicated to his new wife.  She did not pay it while he was gone and he came home to find his cr dropped 100pts with 4+mons deliguent.  He has had a perfect pay record on this card with cap 1..  Does the SCRA cover this or does he write a gw letter?  Thanks so much for the help, he is devastaed as he was hopping to buy a house this year and now that is not even close to possible.

The SCRA does not cover this. Here is an excerpt from Bank Of America's website (I realize it's not the same company but it still applies to your situation)

 

          The bank reported me to the credit bureau as being past due even though I'm currently receiving SCRA benefits. Can the bank report me past due?

 

          SCRA does not relieve you of your responsibility to make payments in a timely manner and it does not prevent the bank from reporting past due payments to the credit                     bureau.

 

If I were your son I would call and talk with Capital One about the situation. If there were ever a situation where they don't want to look bad...this is it! He might be surprised at just how easily they may remove the negative information. Then again...they may stand their ground and tell him to 'kick rocks'.

The SCRA does not remove the obligation to pay credit card debts - it only reduces the maximum allowable interest rate that can accrue on those debts during deployment/active duty, and prevents collection lawsuits or judgments during the same period.

 

Capital One has generally been pretty easy to work with, for me at least.  They may need to adjust his interest accrued during his deployment, which may be enough to overcome a missing minumum payment or two, depending on his balances and rates.  They will likely also agree to waive late fees, but unfortunately there is no guarantee that they will agree to remove late payments.  Thank goodness it's only four, which is bad enough, and not a years' worth... hopefully they will do as PP mentioned and agree for the good karma if nothing else.
