Moved from one state to another ?? about CA

I moved from IN to TX 2 years ago. I have an old co from providian that will hit the SOL wall in Aug of this year per the IN sol. Midland is the current ca on this co but I'm not sure if they have to be licensed in IN to try to collect on a debt that originated in IN. I know they are licensed in TX but when I can't figure out if they are licensed in IN. I tried using the state resources link for IN and plugged in Midland credit management but it comes back with nothing.

 

My question is does the ca have to be licensed in the state the debt occurred or just the state you reside or both?

Licensing obviously varies by state, but you'd want to look for licensing and licensing requirements for Texas and the state they are collecting from (I don't know where they are at). You may also want to include any state where phone calls are originating from (e.g. include FL if the callerID is from FL and so on - they may have a call center in different state that requires them to register or license that center).

I agree with llecs.

 

The only thing you need to consider from the state the debt originated in is the SOL. Make sure that state does not toll SOL.

I've only received mail from Midland and the letters originate in CA and everywhere I've looked up they are supposedly located in CA. While living in IN I had never received anything from this ca.

 

 The DOLA is 8-2003 according to my EQ report and they sol for cc's is 6 years in IN. TX sol is 4 years so I know the sol is based on IN. I'm not responding to mail I receive because I'm in no position to pay this co.

 

I'm only worried that I'll get sued before the sol runs out, which will open another can of worms. Debt is now too large for small claims court due to the fact it has ballooned to over 3 times the original debt.

Toll means stop the running of the SOL clock in certain circumstances.

 

Some states stop the running of SOL when you become absent from the state and the SOL doesn't start again until you come back to the state.

 

The state statutes will state if they do or not.
