llecs i agree totally.  When I make the arrangement I ask them to fax or email and updated arrangement and then I call back with the payment.  They usually always will do this.  I have also studied what to say and what not to say as far admitting to the debt.  I am fortunate that most of mind CA's are all under $750.  While I could still be sued the chance is minimal so the SOL was not that big of deal to me.  They can update it and restart the SOL, but that was a chance I was willing to take.  Especially since I received to responses in the mail from any of them.  Perhaps I was not patient enough, but I have a time line set up for fixing my credit and I need to stick to it.  

 

I am lucky that most of my CA's were actually friendly.  There was only a couple that were not and I won't give them the time of day.   I also search on this site to research the CA's that I have that other people have dealt with.  IE Zenith Acquisition.  I am not going to even attempt to contact them and start the SOL over.  

 

The other thing to note when calling them is the name of the person you spoke with and to get their direct number.  All of them remember me because I follow up in a friendly manner if I don't receive what I am waiting for.

 

I just felt that all the CMRRR that I sent probably were opened and thrown in a trash can and not even looked at.

Would you recommend e-mailing as being more expedient yet as binding as regular CMRR? After all, it is a written communication.

IMO, mail it. I'd send the first few CMRRR, but after several attempts and lack of a "yes", then I'd send it regular mail. Some courts are good at recognizing e-mails and e-mailed agreements, but not all. The challenge with e-mail is that documents can be falsified. A response from the OC/CA on their letterhead is a sure bet.

 

ETA....I'm not down on e-mail. I've sent PFDs via e-mail myself. But if I could choose between the two....

I totally agree with consumer efforts to obtain PFD or GW deletions. So please dont take this post as anti-consumer.

 

But, playing the devil's advocate, credtiors are correct for several reasons in denying PFDs and GWs.

Deletion of prior reporting  is not a consumer right, unless the reported information was inaccurate.

Deletion of accurate, prior posting of derogs is contrary to the integrity of the credit scoring system.  It is arbitrary.

Any party who posts to a CRA has a reporting agreement with the CRA that clearly specifies that deletion of prior, and accurate, reporting should not be deleted based on later payment of the debt that resulted in the posting of the derog. So deletion of prior, accurate reporting is inconsistent with their reporting agreements.

 

Credtitors do PFD and GW deletions because of their own profit motivations.  While each such deletion is probably in violation of their credit reporting agreements with the CRAs, they dont have to provide reasons for any deletion, and thus there is no way to hold them in violation of their reporting agreement.

 

I would not castigate a creditor for refusal of a PFD or GW offer.

Excellent point!

 

Then how does one justify Credit Re-Aging (the good kind) inwhich there are even protocals on standards of implementation by The Federal Financial Institution Council. Then there are guaranteed student loan rehab programs where you bring your defaulted loans to current status and they will wipe out the past delinquencies on your account. Reopening closed credit accounts and back dating them to the original open date.
