Question about Collection Agency

Greetings all,

I have a question regarding one of my old collections accounts.  Up until 2 months ago, I was getting letters from Debt Recovery Solutions regarding paying an old sprint account I had from about 4 years ago.  I thought this debt was bogus, so I disputed it on Experian, and after about 3 weeks, they finally found the debt was invalid, and they removed it.  I just checked the mail today, and got a letter from them saying they just aquired this account from Sprint (again?) and that unless I notify them within 30 days, they will assume the debt is valid.  What, if anything, should I do here?  Should I contact DRS?  Since this exact same account was disputed and after looking into it, was found invalid, can they re report this to Experian? Any help appreciated, many thanks,

Re: Question about Collection Agency

I would send the CA a DV CMRRR. Keep it short and simple, see link below.

If they re-insert, then you must be notified by EX within 3 or 5 days(can't remember off hand) of the re-insertion and EX has to take the proper steps to make sure it is accurate. If you get no notification then you can contact EX stating this was previously deleted as a result of a dispute filed with EX and you were not notified of the re-insertion as required by FCRA and it needs to be removed ASAP.

Re: Question about Collection Agency

Sounds good, I'll send a DV CMRRR tomorrow.  So you are saying that if they do not send me validation of the debt, and they go ahead and report and experian add this to my report,  then I need to notify experian and say that I was not notified as required by FCRA and it needs to then be removed? Thanks

Re: Question about Collection Agency

They aren't allowed to report after receiving a DV and before properly validating.

Re: Question about Collection Agency

Thank you veyr much, greatly appreciate the help.  Does this type of thing happen often?  Managed to clean up my account to just one collection, and hopefully will have that one wiped soon..so I really want to prevent this from going back on.  It just seems strange that they had almost a month to verify the dispute when I did it online with experian, and yet failed to do so, and now they are trying again.  Heck, they cant even spell my name right when they mail me their letters.  Anyways, hopefully I can resolve this soon, its nice to finally be back in the 600's, dont want to start regressing now! Thanks a bunch,
