Question...

Need some advice please. I received a letter in the mail from a CA on a Target account from 98 or 99 I paid off this account in 2000 at that time they had misapplied my payment to another account and they asked me to send them information proving that I had paid it so they could investigate the error on their side. I turned in all the documentation to Target from getting a trace on the money order etc. They removed it from credit report completely. Then I get this letter from the CA I live in the state of Texas I believe this is past the SOL. Here is the thing I no longer have the paper work from when this was taken care I know that I should have kept it but once it was removed off of my credit and seven years had passed I figured it would be ok to shred the papers. So in this lovely collection letter it says if we do not hear from you in 30 Days we will assume this debt is valid yada yada as of Feb 27, 2009 this debt was not reporting on my credit but that does not mean that it wont. I am not sure of where to begin this seems to be so odd and random to meThank you in advance for any advice given. I do not understand how this is even legal.

A debt can only report on your CR for 7 - 7 1/2 years from DOFD.

 

If paid off( or went delinquent according to them) in 2000, then it is past CRTP and for them to report on your CR, they would have to illegally reage.

 

SOL in Texas is 4 years. So, it appears it has past that time as well.

 

IMO, send the CA a FOAD letter.
