I would have disputed with the CRA's myself. TU has told me over the phone agencies DO NOT get in trouble for PFD's. This is a myth. Where the problem lies is with smaller collection agencies (one I'm having difficulty with, they promised Pfd, they didn't, then they said several times they requested removal of a debt that wasn't owed, and they didn't etc). They pay to have these little goodies on your reports (which is why the smaller agencies might only use one report).
Now, to top it off, I PFD two collections (one, aargon, deleted as promised), that I didn't owe. I'm willing to let RCI keep the first payment, but they are violating the fdcpa in demanding all or nothing on multi account collection, they do not contact the original creditor when an item is disputed (I have the phone numbers for all involved), they do nothing but try to make you pay (one time offer only) to delete the oldest debts on account, in a hurry, before you even realize you don't owe the debt.
To get the two debts off that were SUPPOSED to be removed, I had to dispute with TU, whom took the information of promise to delete (which is when I verified that agencies don't get in trouble for doing this, however this was a US rep). RCI wouldn't even respond to the one that was misbilled and verified as pulled from collections. Have to wait the full 30 days.
If perchance that one PFD (they did update to PIF after dispute), remains, then I shall see them in small claims for multiple violations of fdcpa, may get the help of naca.net with this. All debts should have been written off due to charity care. My state does not have a stipulation for backdating charity care, which is why it goes back to 2009, and all hospitals have complied (except for the one that is closed, and I paid the debt without knowing I could backdate with the older office).
It's a YMMV, but it's also a myth that collectors get in trouble for removing information if you agree as part of a contract. The cra's don't care, it's the fact the agencies paid for the info to be there (and aargon admitted they have to spend money to submit removal requests).
Probably where PRA and Midland come into play with this nonsense. Since they want as much profit as possible, submitting deletion requests cuts into bottom line (argon also stated they usually charge extra for deletes).
Just my experience and a little heads up on the CA and collection reporting business. PS, aargon and NCO dropped off very rapidly on all my reports. With CA's, there's always a stinker in the pot.
